Criminal conspiracy: Abuja court adjourns case to June 28
Magistrate court sitting in Abuja has adjourned a criminal case of alleged conspiracy, breach of trust, impersonation and forgery levelled against five accused persons to June 28 for further hearing.
The defence counsel, Barrister G.O.C Owoh who applied for bail for the 1st and 2nd accused persons argued that the offences allegedly committed by his clients were bailable, while assuring the court that his clients will not jump bail if granted.
However, the prosecuting counsel, Barrister John Ijagbemi objected to the bail application by the defence counsel, arguing that the 1st and 2nd accused persons have demonstrated in the past the capacity to evade prosecution.
He told the court that it took security agents a reasonable time to apprehend the 1st and 2nd accused persons, pointing out that granting them bail may jeopardise further hearing of the case.
Ruling on the bail application, the Chief Magistrate, Mrs. Elizabeth Jones granted the 1st and 2nd accused persons bail on fulfilling the bail conditions of N100 million each, a surety who is a resident of Abuja and not less than level 10 officer in the civil service.
The five accused persons Mr. Ogbonna Leo, Robert Okorieukwu, Titus Bolarinwa, Prince Tunde Adesa and Gazama Michael who is still at large are facing cases of alleged criminal conspiracy, breach of trust, impersonation, forgery and using as genuine forged document contrary to section 97, 312, 132m 364 and 368 of the penal code law.
“That on the 21/06/2016 at about 1400hrs, one Mrs. Chinyere Chalete ‘F’ of House 13, E close, Road 21 Estate Lagos state reported to the Commissioner of Police, FCT Command, Abuja against you (1). Ogbonna Leo, (2). Robert Okorieukwu, (3). Titus Bolarinwa, (4). Prince Tunde Adesa and (5). Gazama Michael who is now at large.
“That on the 19/11/2015, the nominal complainant was awarded a contract from police command, Kaduna, Kaduna State to supply twelve thousand bags of rice, and two thousand pieces of laptops, because she did not have money to facilitate the contract and on the process of making contact as to who will financed the contract you: Ogbonna Leo indicated interest and told her you have somebody who will finance the two contract peppers.
“You, Ogbonna Leo and conspired with Robert Okorieukwu, Titus Bolarinwa, Prince Tunde Adesanya and Gazama Michael now at large, presented to her a document bearing a company’s name of Kulmet Integrated Services Limited, and you all deceitfully told her that the company is owned by the Managing Director of Stella Marris College, Abuja and you forged the signature of the Managing Director of the said school. During police investigation, you all confessed to the alleged crime. You all thereby committed the above mentioned offences”.
The 1st and 2nd accused persons pleaded not guilty to the offences.-The Authority
